Tech Tunes, LLC (DBA Esperient) is committed to protecting the privacy of all individuals who visit, register for, or otherwise interact with our platform.

1. Introduction and Scope

Tech Tunes, LLC (DBA Esperient), operating the Esperient platform ('we,' 'us,' or 'our'), is committed to protecting the privacy of all individuals who visit, register for, or otherwise interact with our software-as-a-service platform accessible at https://esperient.com (the 'Platform'). This Privacy Policy explains what personal information we collect, how we use it, with whom we share it, how we protect it, and your rights regarding that information. By accessing or using the Platform, creating an account, or submitting information through any form on our website, you acknowledge that you have read, understood, and agree to the terms of this Privacy Policy. If you do not agree, you must immediately discontinue use of the Platform.

2. Information We Collect

2.1 Information You Provide Directly

  • Account Registration: Full name, email address, phone number, company name, job title, and billing address.
  • Payment Information: Credit card numbers, billing addresses, and related payment details are collected and processed by our PCI-DSS-compliant payment processor. We do not store full card numbers on our servers.
  • Profile & Preferences: Profile photos, notification settings, communication preferences, and any other information you voluntarily add to your account.
  • Support Communications: Messages, attachments, and metadata you submit when contacting our support team via email, phone, or chat.
  • Survey & Feedback Data: Responses to surveys, product feedback forms, or user research studies.

2.2 Information Collected Automatically

  • Usage Data: Pages viewed, features accessed, workflows created, integrations enabled, task execution logs, and click-stream data.
  • Device & Technical Data: IP address, browser type and version, operating system, device identifiers, screen resolution, and referring URLs.
  • Log Data: Server logs recording access times, errors, API request/response metadata (excluding payload content), and session durations.
  • Cookies & Tracking Technologies: We use first-party and third-party cookies, pixel tags, and similar technologies for session management, analytics, and targeted advertising (see Section 7).

2.3 Information from Third Parties

  • Integration Partners: When you connect third-party applications (e.g., Slack, HubSpot, Salesforce) to the Platform, we receive data from those services as authorized by you through OAuth or API credentials.
  • Payment Processors: Transaction confirmations, fraud signals, and chargeback notifications from our payment processors.
  • Business Partners: Lead or contact information from co-marketing partners when you opt in to receive communications from them.

3. How We Use Your Information

  • To create, maintain, and authenticate your account.
  • To provide, operate, and improve the Platform and its features.
  • To process subscription payments, send billing confirmations, and manage renewals and refunds.
  • To send transactional communications (e.g., account confirmations, password resets, invoices).
  • To send promotional and marketing communications where you have not opted out.
  • To provide customer support, respond to inquiries, and resolve disputes.
  • To monitor platform performance, diagnose technical issues, and conduct security audits.
  • To analyze usage trends and conduct product research to improve our services.
  • To detect, prevent, and investigate fraud, abuse, unauthorized access, or other illegal activities.
  • To comply with applicable laws, regulations, legal processes, and government requests.
  • To enforce our Terms & Conditions, Subscription Agreement, and other policies.

4. Legal Bases for Processing (GDPR)

For users in the European Economic Area (EEA) and United Kingdom, we process personal data under the following legal bases: (a) Contract Performance — processing necessary to deliver the Platform services you have subscribed to; (b) Legitimate Interests — fraud prevention, security, analytics, and improving our products; (c) Consent — marketing communications and non-essential cookies; and (d) Legal Obligation — compliance with applicable law.

5. How We Share Your Information

  • Service Providers: We share personal data with vetted third-party vendors who perform services on our behalf, including cloud hosting, payment processing, email delivery, analytics, customer support tooling, and fraud prevention. These vendors are contractually prohibited from using your data for any purpose other than providing services to us.
  • Integration Partners: When you enable a third-party integration, you authorize us to transmit data to and receive data from that third party's systems. Data shared with integration partners is governed by their respective privacy policies.
  • Business Transfers: If Esperient is involved in a merger, acquisition, asset sale, or bankruptcy proceeding, your personal data may be transferred as part of that transaction. We will provide notice before your data becomes subject to a different privacy policy.
  • Legal Requirements: We may disclose your information if required to do so by law, court order, subpoena, or government authority, or if we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of Esperient, our users, or the public.
  • No Sale of Personal Data: We do not sell, rent, or trade your personal information to third parties for their own marketing purposes. California residents have additional rights under the CCPA as described in Section 11.

6. Data Retention

We retain personal data for as long as your account is active, as necessary to provide the Platform, and as required by applicable law. Upon account termination, we will delete or anonymize your personal data within 90 days, except where we are required to retain certain information for legal, tax, or audit purposes (typically up to 7 years for financial records). Integration-sourced data is deleted within 30 days of disconnecting the relevant integration.

7. Cookies and Tracking Technologies

  • Strictly Necessary: Session tokens and authentication cookies required for the Platform to function. Cannot be disabled.
  • Performance/Analytics: Tools such as Google Analytics to measure usage patterns. You may opt out via your browser settings or our cookie preference center.
  • Functional: Cookies that remember your preferences and settings.
  • Marketing/Advertising: Pixels and trackers used for retargeting and measuring ad campaign effectiveness. Opt-out available through our cookie preference center or industry opt-out tools (NAI, DAA).

8. Data Security

We implement industry-standard technical and organizational measures to protect your personal data, including: AES-256 encryption at rest; TLS 1.3 encryption in transit; zero-trust network architecture; role-based access controls; continuous monitoring and intrusion detection; SOC 2 Type II audited controls; and regular penetration testing. Despite our best efforts, no security system is impenetrable. In the event of a data breach affecting your rights, we will notify you as required by applicable law.

9. International Data Transfers

Esperient is operated from the United States. If you are located outside the United States, your information will be transferred to and processed in the United States. For EEA/UK users, we rely on Standard Contractual Clauses (SCCs) as the legal mechanism for such transfers. By using the Platform, you consent to this transfer.

10. Your Rights and Choices

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete personal data.
  • Deletion: Request deletion of your personal data, subject to legal retention requirements.
  • Portability: Request your data in a structured, machine-readable format.
  • Objection/Restriction: Object to or request restriction of certain processing activities.
  • Withdraw Consent: Where processing is based on consent, withdraw that consent at any time.
  • Opt-Out of Marketing: Unsubscribe from promotional emails at any time using the unsubscribe link or by emailing help@esperient.com.

11. California Privacy Rights (CCPA/CPRA)

California residents have the right to: (a) know what categories of personal information we collect and why; (b) request deletion of personal information; (c) opt out of the sale or sharing of personal information; (d) non-discrimination for exercising privacy rights; and (e) correct inaccurate personal information. To submit a verifiable consumer request, contact us at help@esperient.com or 857-858-8670. We do not sell personal information as defined under the CCPA.

12. Children's Privacy

The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that a minor has provided us with personal information, we will delete it promptly. If you believe a minor has submitted personal data to us, contact us at help@esperient.com.

13. Changes to This Privacy Policy

We may update this Privacy Policy periodically. We will notify you of material changes by posting the updated policy on our website with a revised effective date and, where required by law, by sending you an email notification. Your continued use of the Platform after the effective date of changes constitutes your acceptance of the updated policy.
